1. Acceptance of terms
By creating an account or using Tom Hospital (TomHospital.com) you agree to these Terms & Conditions, our Privacy Policy and our Refund Policy. If you do not agree, please do not use the platform.
2. What the service is — and is not
Tom Hospital provides AI-generated health information and educational guidance based on World Health Organization (WHO) guidelines and recognized clinical protocols, across 15+ specialties, including AI-assisted interpretation of uploaded health reports.
The service is not a licensed physician, does not practice medicine, and does not provide a medical diagnosis, prescription or treatment plan. AI output may be incomplete, outdated or wrong. Always seek the advice of a qualified physician for any medical decision.
3. Emergencies — immediate care rule
The platform must never be used for medical emergencies. If you experience chest pain, difficulty breathing, stroke symptoms, severe bleeding, suicidal thoughts, or any acute condition, stop using the platform and call your local emergency number immediately — 112 in India, 911 in the US, or your local equivalent.
4. Accounts and eligibility
You must provide accurate registration details, keep your credentials confidential, and be at least 18 years old (or use the platform under a parent/guardian account). You are responsible for all activity under your account. We may suspend accounts that abuse the service, attempt to extract the AI engine, or breach these terms.
5. Membership, billing and renewal
Full access is offered as a monthly subscription, billed in advance through Cashfree Payments (₹999/month, India) or PayPal (US$14.99/month, worldwide). Subscriptions renew automatically each month until cancelled. You may cancel anytime; access continues until the end of the paid period. Prices may change with 30 days' notice. Payment processing is handled by the gateways under their own terms.
6. Acceptable use
- Do not upload reports of another person without their consent, or content that is unlawful.
- Do not use the output to self-prescribe prescription-only medicines or to replace urgent care.
- Do not scrape, resell, or reverse-engineer the AI consultation engine.
7. Intellectual property
The platform, its AI engines, content and branding are owned by Tom Hospital or its licensors. You receive a personal, non-transferable right to use the service for your own health questions. You own the content you submit.
8. Disclaimers and limitation of liability
The service is provided "as is" without warranties of any kind, to the maximum extent permitted by law. Tom Hospital and its team are not liable for indirect, incidental or consequential damages, or for any decision made or action taken in reliance on AI output. Nothing in these terms limits liability that cannot be limited under applicable law.
9. Indemnity and changes
You agree to indemnify us against claims arising from your breach of these terms. We may update the service and these terms; material changes will be announced on the platform, and continued use after notice constitutes acceptance.
10. Governing law and contact
These terms are governed by the laws of India, with courts in the operator's home jurisdiction having exclusive jurisdiction, without prejudice to mandatory consumer protections in your country of residence. Questions: support@tomhospital.com.
